Special Needs Trust 

Settling a lawsuit for a physically or mentally disabled individual under 65 years of age may require special consideration.  To prevent the interruption of any benefits the claimant is receiving from the government, the creation of a Special Needs Trust (SNT) may be necessary.  All settlement monies can then be deposited into the trust which can then be used to purchase approved goods and services for the beneficiary.  This allows the claimant to receive the full settlement amount without sacrificing eligibility for Supplemental Security Income (SSI), Medicaid or other government benefits.  Created by the Federal Omnibus Budget Reconciliation Act of 1993, Special Needs Trusts (SNT) can be funded with lawsuit recoveries of cash or structured settlement installments.  If the claimant does not have a parent, grandparent, or guardian, the court can set up a Special Needs Trust for receipt of the settlement.
 

Settlement Trust (Individual & Pooled)

Court Created Trust (Section 142 & Chapter 1301)

The James Street Group, LLC administers trusts under Section 142 of the Texas Property Code as well as the Texas Estates Code of Chapter 1301 (formerly 867).  The James Street Group, LLC is aware that ultimately getting from resolution to final distribution of a recovery can be time consuming for the attorney as well as for his or her clients.  Our team of experienced settlement experts has the insight and expertise to help guide the claimant to create a recovery management plan that protect his or her best interest.  The James Street Group, LLC will work to alleviate the attorneys adminstrative burden, creating a comprehensive plan to protect the claimant and coordinate the distribution of their recovery with the appropriate funding vehicle.
